A. The article by Lyndal M. Bullock and Robert A.Gable is devoted to the important and ever urgent topic of the difficult problems that teachers and other educational professionals encounter during their attempts to find effective ways for a proper inclusion of children and adolescents with emotional and behavioral disorders (E/BD) into the educational processes, either in frames of the general educational institutions, or under the auspices of special programs and educational settings specifically designed for those having various forms of E/BD.The format of the article is such that it includes both general historical and factual information about the discussed field, and sets forth several research question s that are elaborated and partially answered by the authors during the course of the article. Considering the mentioned points, the main strength of the article is the ability of the authors to synthesize specific information in such a way as to make it understandable not only to experienced educational professionals, but as well for younger ones to whom the authors appeal in the article as they discuss personnel shortages presumably with the aim to interest new potential specialists on E/BD.Also, the strength of the article is its successful combination of historical data and forecasts, which gives the sense of the direction of the development of the discussed field. As a weakness of the article may be identified its lack of inclusion of relevant forei gn experience which might add useful insights on E/BD treatment.F. Similarly to the above mentioned strength of the article, I believe that I should use the strategy of integral and coherent presentation of information in my teaching because it helps students correctly appreciate the general context that any given information is almost always placed in. In practice, this way of presentation of information can increase the interest and personal involvement of students in the process of study, and may help them immediately see how even a small contribution of one teacher can have significance for many people.

Presently, there is room for opportunity, to actually analyze the Human Resource Management system and see what are the problems which are leading employees to show lack of motivation. (Riordan Manufacturing, p.2) Through various research, employees and outside sources, especially Human Capital Consulting firms, believe that financial compensation is lower than market value. Employees are also not comprehending how pay intertwines with job performance. 2003 to 2004 surveys show that employees think that pay connects to seniority. (Chen & Hsieh, 2006, p.13) Adding to standard compensation, individual rewards are not well connected to performance. For example, departments like IT and R&D focus the sales force and rarely see no return. The lack of proper positioning for financial compensation and work performance is causing confusion and affecting the motivational problems. Riordan Manufacturing needs to acknowledge that employees views need to be considered. Hence why the distance in understanding between the employees and the business needs to be fixed. Alterations to financial compensation can be expensive. The consultant from Human Capital Consulting the reward and compensation system needs to be fully reformed. The total cost of the reward system alterations are about $175,000. Since the business has been dealing with sales declining an investment of that sort would put the organization at a high risk. Even though it has to deal with that expense the organization has the chance to compete better in the market and lessen the risk of losing employees to other businesses due to financial compensation formats. Also, form career development plans and spot out important achievements within the business. Not only employee motivation should be worked on, but also set up a comprehensive rewards system. The primary reason for the Borden Foods to divert itself from snacks is to emphasis its efforts and resources in the growth of their whole-wheat meal segments. Response Paper Number Two: The Miranda Warnings as They Pertain to Criminal Procedure Miranda v. Arizona, 384 U.S. 436 (1966): Helping the Accused While Hampering the Accuser The landmark case of Miranda v. Arizona, 384 U.S. 436 (1966) set a new legal precedent, and the repercussions are still being felt today. The result of the decision in Miranda, 384 U.S. at 436 was that the confession of one Ernesto Miranda was declared by the United States Supreme Court to be inadmissible in his trial, due to the fact that Miranda had not been advised that he had the right to remain silent, or to have counsel present prior to making the confession. Because of this, according to the Fifth Amendment, which states, in part, that â€Å"No person shall†¦be compelled in any criminal case to be a witness against himself†, his rights had been violated, and his confession was therefore inadmissible. Directly due to this, the conviction that had been originally found was reversed, and the case was sent back for a new trial. This decision by the United States Supreme Court, in considering the balance between abuse of individual rights and freedom for the innocent while allowing police to do their job in maintaining justice swung the balance powerfully in favor of those that stand accused of crimes, while negatively impacting the interests of the police in doing their job to put those who are guilty in prison. Miranda warnings are the same overall, no matter who receives them; they were designed that way to give a standard warning of rights that the accused was entitled to. The first se ntence states that the accused has â€Å"the right to remain silent† (Scheb & Scheb II, 2012). This means that as long as a person says absolutely nothing, unless the police have some form of hard evidence, they most likely cannot gain a conviction. Professor James Duane backs this up in the video lecture â€Å"Don’t Talk to Police† when he gives eight top reasons as to why no one, under any circumstances, should ever talk to the police. Chief among these reasons is that even if someone is innocent, something that is said, however innocent, even if it is the barest tidbit of information, could cause them to be accused or even convicted of a crime (Duane, 2008). That being said, again, as long as the accused remains silent, they retain the power of not only their right to do so but the power to hinder the police that are trying to convict them. It said that not many organizations are taking into account the comprehensive health issues, medical systems and reimbursement, environmental issues, and education that are necessary to help older Americans live better. To utilize available funds effectively, resources must be tailored to the needs of the aged. The 25% of the population who are over age 50 today control 70% of the total net worth of U.S. households and are seasoned consumers (Dychtwald 1990). Creative Writing Essay The seven habits described in Stephen R. Covey’s book, The Seven Habits of Highly Effective People, are life-altering improvements that require hard work and commitment to change oneself from within. The book has been considered a milestone in the genre of self-help books. First published in 1989, it has been assisting many people since. The first habit, ‘Be Proactive: Principles of Personal Vision,’ is the foundation, the beginning steps towards effectiveness. The whole point that Covey emphasizes on is that; the manner in which two types of people react, which is similar to the difference between day and night. These people are proactive and reactive; the former focuses on values, the latter on feeling. Nevertheless, proactive people can be said as void of much feelings and emotions. This outlook can be seen as a potential disadvantage to those who seek to bring a change in themselves. Proactive people see love as a verb, not feeling and interactivity is their best tool; a little more than unnerving for many people. The reason for this is that we depend wholly on ourselves alone or on others alone; never believing in interaction. Proactive people consider the ‘I can be’ of themselves whilst, reactive people concentrate on the ‘If I have’ in life. The author says that if we think any problem as being ‘out there’ then that though is the problem. Yet, the author thinks it is innocuous to guide people by motivating them but disregards the thinking process. Pro-activity then, is not much different from reactivity, the strong point of the animal world, if we do not think over what we are about to do (Orsini, 1996). It seems that Covey’s actual point here is self-control which comes foremost when we aim to be morally uncorrupt. Covey has used his own terminology to describe various phrases in the book. For instance, the phrase: inside-out approach in various situations in life. It says that the change from within is more prominent and permanent than a mere change from outside (Weber, 2009). Character sprouts from our attitude and the way we behave; changing it will be the progress. His ‘principles of personal vision’ doesn’t really relate to each other. There is a different concept under every heading in this habit. Every human being has its own set of responsibilities; this idea arouses feelings of uncertainty. It is so very easy to abandon our responsibilities in the name of others’ weaknesses. We cannot accept the fact that everything we do in our life is our decision; even when we are forced. Another aspect of this is that, we ourselves have to take initiatives and provide ourselves with opportunities. It isn’t right if someone keep saying, ‘If I could only be more slim and lean,’ and does nothing about it. If outside authorities mold our choices, we cannot be held answerable for our actions, this defines determinism. Covey defines this as a phenomenon that puts the blame on others. The theory is that we will act in the way that we are trained to do so; by our genetics, psyche or our environment. All in all, the phenomenon doesn’t help in the 21st century because people don’t care anymore if they are socially acceptable. Since the start of this century, we have succeeded in steering clear out of the grasp of so-called conditioning and determinism. Nevertheless, many people do not recognize the amazing ability of our mind to choose the way to respond to a stimulus. Only our body can be reined in but not our mind. We have the incredible power to imagine, of an independent will and self-awareness. To be self-aware is like to be able to see yourself from afar; to assess yourself and the way your mind works. This ability is unique in humans. On the other hand, the philosophy of free will is not accepted by several people. Outside influences only affects those people who let them affect them. When we acquire the skill to create circumstances, we also gain the power to empower them. Just as there was a woman who helped her boss overcome his weakness by compensating her own talents; this made her more trustworthy. It isn’t sufficed to say that, we have no control over the events that takes place in our lives. If the character is built up to concentrate otherwise, then the theory isn’t acceptable to the psyche. The reality is that deep down inside we have a conscience which is always making us aware of what is right and wrong; and yet we can choose to ignore it or be aware of it and do something required to be done. Then it only becomes a question of utilizing it and a choice to be either kind or cruel. At times humans can burry it as deep inside as if it isn’t there at all. The author’s discussion about the Circle of Concern and the Circle of Influence is not very convincing. It is hard for a person to follow the concept and its advantages. It acknowledges the fact, that people usually focus their energy and efforts worrying about futile concerns. There are some incidents which we can only be concerned about and others, which we can successfully mold into a result that we require. We can, directly or indirectly, control some situations in life. This is secondary to our Circle of Influence. It says that we can choose our actions, but not the consequences that come with the actions that we chose. Hence, our actions cannot guarantee that we will not fall. Then the author describes this habit further by saying that, we should accept our mistakes and correct them. In addition, we should also be aware that we cannot undo them, so regret is a pointless exercise. Between both these points is the fact that we can still commit mistakes. The book talks about making and keeping commitments; which we can do so if we start small and grow bigger. Essentially, we will be developing habits by keeping our commitments and achieving goals. A bit far fetched logic, but reasonably sought out. From our language to our response towards people, all things determine our character and the level of our proactive or reactive behavior. No one can hurt us without our permission; we can decide that we are not going to be affected by certain events in our life. The day we accept that we are the ones responsible, that’s the day we truly begin to see ourselves. This habit ultimately aims to build up our character. Canada Statutory Law Analysis David Kafka Californias statutory law establishes that employment, having no specified term, may be terminated at will by either the employer or employee. Cal. Lab. Code ÂÂ § 2922 (2017). This presumption is subject to contrary evidence, such as an implied or expressed agreement that an employment relationship will continue indefinitely. The issue in this case is whether Reynaldo Perez had an implied contract of employment with Malloys Department Store that could be terminated only for cause. If an employer has created an implied or expressed contract for permanent employment, that employee may be terminable only for good cause. When determining if an implied agreement exists, the court will look at a number of factors. These include: personnel policies or practices of the employer, employees longevity of service, assurances by the employer for continued employment, and practices of the industry. Formal handbooks and manuals outlining employment terms are also given consideration. An implied covenant of good faith protects the parties right to receive the benefit of their agreement, but does not necessarily create any other duty outside of the contract. Pugh was found to have had an implied agreement with Sees Candies based on his duration of employment, lack of criticism for work, assurances given, and his employers acknowledged policies. Pugh v. Sees Candies, Inc., 116 Cal. App. 3d 311 (1981). Pugh was frequently told that if he did a good job, his future with the company was secure. There was also a policy where administrative staff would only be fired for good cause. Pugh was not given a reason for his termination, nor was it based on good cause. The court found that an implied contract existed, and Pugh was wrongfully terminated. Id. At will provisions in company manuals are significant in determining the policies of an employer. Parol evidence is admissible to explain, supplement, or even contradict the terms on an unintegrated agreement Guz v. Bechtel Natl, Inc., 8 P.3d 1089 (Cal. 2000). When an employer has policies in formal handbooks, it create[s] a clear and uniform alternative to haphazard practices, understanding, and arrangements within the company. Id. Guz was told by a Bechtel official that the company avoids arbitrary firings. However, the court found that the company did not waive its right to discharge its employees at will based on this statement. Id. The court places great credence in what is included in formal handbooks when determining if employment is at will. An official cannot waive those policies simply by making his or her own arrangements. Guz received no promises that he would be retained except for good cause. His long employment, raises, promotions, and good reviews were not sufficient enough to prove that an implied contract existed where he was no longer an at will employee. The court found that the implied covenant of good faith did not protect Guz from termination. Id. Perez was employed at Malloys for a total of 20 years, consistently received good evaluations, had salary increases, and on one occasion was given assurance his job was safe if he kept performing at a certain level. Perez was told early in his employment by the president of Malloys that his job would always be safe, and that the company doesnt just fire people. The length and success of his employment might also benefit his argument for an implied contract. The companys application form contained ambiguous language which could be interpreted as a contract for continued employment. It stated that Malloys hires and retains hard-working people. However, both the application form and employee manual reiterate that employment is at will. The application stated our employment relationship will end whenever we determine that it should. The employee manual had similar language, stating that an employee could be fired at any time, for any reason. It is likely that the employee manual and job application form will be given great consideration. Malloys clear policy of employment at will was outlined in these documents and contradict any promise that was made to Perez early in his career. As in Guz v. Bechtel Natl, Inc., 8 P.3d 1089 (Cal. 2000), an employee handbook is admissible in court to explain or contradict terms of an unintegrated agreement. In Perezs case, the handbook will likely contradict the presidents statement that his job would always be safe. Perez agreed with the company president that he was fine with his reassignment. He continued working in this position for an entire year. There was never a clear agreement that Perez would only be fired for just cause, and there was no indication that this was Malloys company policy. Therefore, it is unlikely that the court will find that Perez had an implied contract of employment that could be terminated only for cause.
